Provider: MAKRI LLC d/b/a VOICEEM LLC, a Texas limited liability company ("VOICEEM / VOICE’EM", "we", "us", or "our").

This Refund Policy explains how subscriptions, premium features, cancellations, and refunds work on the VOICEEM / VOICE’EM platform and related mobile applications available at www.VOICEEM.com (the "Platform"). This Refund Policy is incorporated into and forms part of the VOICEEM / VOICE’EM Terms of Service (the "Terms") and should be read together with the Terms and the VOICEEM / VOICE’EM Privacy Policy. Capitalised terms not defined here have the meaning given in the Terms.

The Platform is intended solely for adults aged 18 years or older and is used by Users worldwide. By purchasing a subscription or premium feature, you acknowledge that you have read, understood, and agree to this Refund Policy. If you do not agree, do not purchase a subscription or premium feature.

  • You can cancel your subscription at any time.
  • When you cancel, your premium access continues until the end of the period you have already paid for, and you will not be charged again unless you re-subscribe.
  • We generally do not give refunds for days you did not use in a billing cycle, unless the law where you live requires it or VOICEEM / VOICE’EM support approves a refund in an exceptional case.
  • Any refund we do give is a one-off and at our discretion; it does not mean you will get one again.

1. Subscriptions and Premium Features

1.1 The Platform may offer paid subscriptions and premium features that provide access to additional functionality ("Subscriptions" and "premium features"). Subscriptions are billed in advance on a recurring basis for each billing period (for example, monthly or annually), as described at the point of purchase. This Refund Policy governs Subscriptions and premium features; fees paid for advertising, banners, polls, surveys, and sponsored campaigns are governed by Clause 15 of the Terms, including that, unless a guaranteed-impression package is purchased, estimated impressions are not guaranteed and amounts paid for estimated, non-guaranteed impressions or campaign results are non-refundable except as required by applicable law.

1.2 By purchasing a Subscription, you authorise VOICEEM / VOICE’EM and its payment processors to charge the applicable fees and any taxes to your selected payment method for each billing period until the Subscription is cancelled in accordance with this Refund Policy. Payment card details are processed by third-party payment processors and are not stored by VOICEEM / VOICE’EM.

2. Cancellation

2.1 You may cancel your Subscription at any time through the methods described in Clause 5.

2.2 Cancellation takes effect at the end of the current paid billing period. Your premium access continues until the end of that billing period, after which the Subscription will not renew.

2.3 After cancellation, you will not be charged any further Subscription fees unless you choose to re-subscribe. Re-subscribing starts a new Subscription subject to the then-current fees and terms.

3. Refunds

3.1 Partial refunds are generally NOT provided for unused days, time, or features remaining in a billing period after cancellation. Subscription fees are charged for the full billing period and are non-refundable except as set out in this Clause 3.

3.2 The general no-partial-refund rule in Clause 3.1 does not apply, and a refund may be available, where:

  • (a) a refund is required by applicable law, including the mandatory consumer-protection rights of Users located outside the United States that cannot lawfully be excluded or limited; or
  • (b) VOICEEM / VOICE’EM support approves a refund in an exceptional case at its sole discretion.

3.3 Where a refund is granted, it will be made using the original payment method where reasonably practicable (or another method at our discretion), for the amount we determine, and within a reasonable time, subject to processing times of the relevant payment provider. We do not pay interest on refunds except to the extent required by applicable law.

4. Discretionary Nature of Refunds

4.1 Except where a refund is required by applicable law, any refund is provided at VOICEEM / VOICE’EM's sole discretion as a one-time accommodation. The grant of a refund in any instance:

  • (a) does not create any entitlement, right, or expectation to a refund in any other instance;
  • (b) does not establish a course of dealing, waiver, or precedent; and
  • (c) does not modify this Refund Policy or the Terms.

4.2 VOICEEM / VOICE’EM reserves the right to grant, decline, or condition any discretionary refund request, and to determine the amount and method of any refund, in its sole discretion, except to the extent otherwise required by applicable law.

5. How to Cancel and Request a Refund

5.1 To cancel a Subscription or to request a refund, contact VOICEEM / VOICE’EM through the "Help & Support" menu located under your profile on the Platform, and follow any cancellation or refund-request steps made available there.

5.2 We may ask you to verify your identity and Account and to provide information reasonably necessary to process a cancellation or refund request.

6. Chargebacks, Payment Disputes, and Abuse

6.1 If you believe you have been charged in error, please contact us first through the "Help & Support" menu so we can review and, where appropriate, resolve the matter.

6.2 Initiating a chargeback or payment dispute without first attempting to resolve the matter with us, or in bad faith, may be treated as a breach of the Terms. VOICEEM / VOICE’EM reserves the right to dispute and respond to chargebacks and payment disputes and to recover amounts owed.

6.3 VOICEEM / VOICE’EM reserves the right to suspend, restrict, block, or terminate access to Subscriptions, premium features, or the Platform in the event of fraudulent, abusive, or improper chargebacks or payment disputes, or other abuse of this Refund Policy, without notice and without refund, to the extent permitted by applicable law and consistent with the Terms.

7. Changes to this Refund Policy

7.1 We may update this Refund Policy at any time in our sole discretion. The revised version becomes effective when posted on the Platform or on the date stated in the revised version. Your continued use of the Platform, or continued or renewed Subscription, after any change constitutes your acceptance of the revised Refund Policy. We encourage you to review this Refund Policy periodically.

8. Governing Law and Disputes

8.1 This Refund Policy is governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict-of-laws principles.

8.2 Any dispute arising out of or relating to this Refund Policy is subject to the dispute-resolution provisions of the Terms, including the exclusive jurisdiction and venue of the state and federal courts located in Texas, the class-action waiver, and the jury-trial waiver, as set out in the Terms. Nothing in this Refund Policy limits any mandatory consumer-protection rights you may have under applicable law that cannot lawfully be excluded.
