1. What Cookies and Similar Technologies Are
1.1 Cookies are small text files placed on your device (computer, tablet, or mobile) when you access or use the Platform. "Similar technologies" include software development kits (SDKs), pixels, web beacons, tags, local storage, device identifiers, and other tracking mechanisms that perform functions comparable to cookies. In this Cookies Policy, references to "cookies" include these similar technologies unless stated otherwise.
1.2 Cookies may be session cookies, which are temporary and are deleted when you close your browser or app session, or persistent cookies, which remain on your device for a set period or until you delete them. Cookies may be set by VOICEEM / VOICE’EM ("first-party cookies") or by third parties whose services we use ("third-party cookies"), as described in Clause 4.
2. Categories of Cookies We Use
2.1 We group cookies into the following categories:
- (a) Strictly necessary / essential cookies — required to operate the Platform, maintain your session, authenticate your Account, enable security and anti-bot measures, and provide core features. These cookies cannot be switched off through our controls without affecting how the Platform functions.
- (b) Functional / preferences cookies — used to remember your choices and settings (such as language, region, display preferences, and login state) and to personalise your experience.
- (c) Analytics / performance cookies — used to understand how Users interact with the Platform, measure usage and performance, diagnose errors, and improve the Platform.
- (d) Advertising / targeting cookies — used to deliver, measure, and manage advertisements, banners, polls, surveys, and sponsored campaigns on the Platform, to limit how often you see an advertisement, and to assess campaign performance.
3. What Data Cookies Collect and How We Use It
3.1 Depending on their category, cookies may collect or process information such as device and browser type, operating system, app version, IP address, device and online identifiers, session and login state, pages and feeds viewed, interactions and approximate usage analytics, preferences and settings, and approximate location derived from your IP address (used, for example, to determine your country). This is consistent with the information described in the VOICEEM / VOICE’EM Privacy Policy.
3.2 We use cookies to: (a) provide, operate, maintain, and secure the Platform and its features; (b) authenticate Users and protect against fraud, abuse, and unauthorised access; (c) remember your preferences and settings; (d) enable and support location-based features where you have voluntarily enabled location sharing, including IP-based country determination; (e) analyse and improve the Platform and its performance; and (f) deliver and measure advertising and campaigns on the Platform.
3.3 Cookie data is used to support your use of the Platform and, where relevant, location-based features. VOICEEM / VOICE’EM does NOT share User information, including cookie or location data, with marketing agencies, consistent with the Privacy Policy and the Terms.
4. First-Party and Third-Party Cookies
4.1 First-party cookies are set by VOICEEM / VOICE’EM and are used to operate the Platform, authenticate Users, remember preferences, and analyse and improve the Platform.
4.2 Third-party cookies are set by trusted third-party providers whose services we use to operate, measure, and support the Platform. The categories of third parties whose cookies or similar technologies may be used on the Platform include: (a) analytics and performance providers; (b) advertising and ad-measurement partners; (c) hosting, content-delivery, and security providers; and (d) payment processing and identity-verification providers. These third parties may process information under their own privacy and cookie policies, and VOICEEM / VOICE’EM is not responsible for the practices of any third party (see the Privacy Policy).
4.3 VOICEEM / VOICE’EM does NOT share User personal information with marketing agencies. The use of advertising and analytics cookies on the Platform is for delivering and measuring advertising and analysing usage on the Platform itself, and does not involve sharing User personal information with marketing agencies. Any data, metrics, or analytics that advertisers, developers, or measurement partners obtain through Platform advertising tools, APIs, or cookies are subject to the data-use and resale restriction in Clause 15.7 of the Terms, and must not be sold, shared, re-identified, or used to profile or re-target Users off the Platform.
5. Cookie Categories, Purposes, and Duration
5.1 The following table summarises the categories of cookies we use, their purpose, and their typical duration. Specific cookies and durations may change as we update the Platform; the categories below describe how we use cookies generally.
| Category | Purpose | Type / Duration |
|---|---|---|
| Strictly necessary / essential | Operate the Platform, maintain sessions, authenticate Accounts, enable security and anti-bot measures, and provide core features | Mostly session; some persistent (typically up to 12 months) |
| Functional / preferences | Remember settings and choices such as language, region, display preferences, and login state | Session and persistent (typically up to 12 months) |
| Analytics / performance | Measure usage and performance, diagnose errors, and improve the Platform | Persistent (typically up to 24 months) |
| Advertising / targeting | Deliver, measure, and manage advertising and campaigns, and limit advertisement frequency | Persistent (typically up to 13 months) |
6. Consent and Managing Your Cookie Preferences
6.1 Strictly necessary cookies are required to operate the Platform and are set on the basis of our legitimate interest in providing a secure, functioning service. Where required by applicable law, we obtain your consent before setting non-essential cookies (functional, analytics, and advertising cookies).
6.2 You can manage, disable, refuse, or withdraw your consent to cookies at any time through:
- (a) your browser or device settings — most browsers and devices allow you to block or delete cookies, refuse third-party cookies, clear local storage, and reset advertising identifiers; and
- (b) any in-app or on-Platform cookie preference controls we make available, where provided.
6.3 Where we obtain consent for non-essential cookies, you may withdraw that consent at any time using the controls described above. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal. Changes to your browser, device, or app settings apply only to the browser, device, or app on which you make them.
7. Consequences of Disabling Cookies
7.1 You are free to disable or refuse cookies. However, if you disable or block strictly necessary / essential cookies, the Platform may not function properly, and you may be unable to log in, maintain a session, access secure areas, or use core features.
7.2 Disabling functional, analytics, or advertising cookies will not prevent you from using the core Platform but may affect personalisation, remembered preferences, performance measurement, and the relevance and measurement of advertising.
8. Do-Not-Track Signals
8.1 Some browsers offer a "Do-Not-Track" ("DNT") setting that sends a signal to websites and services you visit. There is currently no consistent industry or legal standard for how DNT signals should be interpreted. Unless required by applicable law, the Platform does not currently respond to DNT signals. You can still manage cookies using the methods described in Clause 6.
9. Changes to this Cookies Policy
9.1 We may update this Cookies Policy at any time in our sole discretion. The revised version becomes effective when posted on the Platform or on the date stated in the revised version. Your continued use of the Platform after any change constitutes your acceptance of the revised Cookies Policy. We encourage you to review this Cookies Policy periodically.
10. Governing Law
10.1 This Cookies Policy is governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Cookies Policy is subject to the exclusive jurisdiction and venue of the state and federal courts located in Texas, and to the class-action waiver and jury-trial waiver, as set out in the Terms.
